This agreement applies to and between you, the User of this website and Oilee LLC (www.oileemobile.com). Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website or our mobile application. If you do not agree to be bound by these Terms and Conditions, you should stop using the Website or mobile application immediately. Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using this website and any mobile application (the "Service") operated by Oilee LLC or www.oileemobile.com ("us", "we", or "our").

In this Agreement “you” and “your” refer to our customers, prospective customers, and users of our website, “we”, “company”, “us” and “our” refer to www.oileemobile.com or Oilee LLC and “Service” refers to the services provided by us. Party”, “Parties”, or “Us”, refers to both the Customers and ourselves, or either the Customer or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to our customers in the most appropriate manner, for the express purpose of meeting the customer’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing laws. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Any and all use of our services is subject to this Agreement, which may be updated by us from time to time without prior notice to our customers. Any change of terms shall be binding and effective upon posting of the revised Agreement on our website. In addition to this Agreement, specific services or information contained within this website and/or mobile application may be subject to additional posted terms or guidelines applicable to such services. All such terms or guidelines are hereby incorporated by reference into this Agreement.

By using www.oileemobile.com (the “Site”) or any of our services (“Services”) or mobile application (the “mobile app”), you agree to follow and be bound by these Terms of Services (the “Terms of Services”) and agree to comply with all applicable laws and regulations.

Unauthorized access
It is unlawful to try and gain unauthorized access to the site or mobile app, its servers, or any computer or database connected to the Site or mobile app. You must not attack the Site or mobile app via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you will be committing a criminal offence. In the event of such a breach, your right to use the Site or mobile app will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site/mobile app or to your downloading of any material posted on it, or on any website linked to it.

Order process

To ensure we complete your order adequately and in due time, you are required to do the following:

  1. You shall create an account/signup on our website and/or mobile app;

  2. Our system shall verify if this submission is valid;

  3. If your submission is verified, you can go ahead to make an order;

  4. You must select from our list of services provided on the website and mobile app the best applicable option to you. Please be advised that you shall be required to make payment immediately using your credit card;

  5. After making the order by entering your card details, a confirmation email shall be sent to the email address you have provided while creating your account/sing up.

    PLEASE BE AWARE THAT YOU ARE REQUIRED TO SUBMIT THE FOLLOWING TO ENSURE WE ADEQUATELY PROVIDE YOU WITH THE RIGHT SERVICE A] YOUR FULL NAME AS IT APPEARS ON YOUR DRIVER’S LICENSE, B] COLOR OF YOUR CAR, C] LOCATION WHERE YOU WOULD WANT US TO CHANGE THE OIL, D] PLATE NUMBER OF YOUR CAR.

All orders placed on our website will be subject to acceptance in accordance with the terms and conditions of Oilee LLC. Please ensure your vehicle is at a safe location at all times. By making an order, please be advised that you are granting our technician access to enter your vehicle if required to provide services to you.

Subscription 
For our subscription services, there is a setup fee of $40 (prices is subject to change and at the discretion of Oilee LLC). Subscription shall be as follows: 

TIER 1 $39.99 EV $39.99
TIER 2 $49.99 EV $49.99
TIER 3 $59.99 EV $59.99

Subscription fees are final and non-refundable upon payment. Notwithstanding the foregoing, you may cancel a subscription before the next billing cycle. Any cancellation notice must be provided at least 10 days before the end of the current subscription billing cycle. Any cancellation request within 10 days of the current subscription billing cycle will only be terminated after the next subscription billing cycle e.g., if a client wishes to terminate their subscription on the 1st of August, they must provide a notice by 21st July to cancel. Any cancellation request after the 21st of July will only be cancelled after the August subscription.

Payments

If you wish to purchase any of our product or service made available on the website or mobile app, you may be asked to supply certain information relevant to your Purchase including, without limitation, your name, your phone number, house address, email address, card details, make of car, car plate number, car colour, location and any such information needed by us for you to make payments and provide service to you. All payment shall be made on the site or mobile app and via a card payment or by any means (this include but are not limited to direct debits, card payments, PayPal) set on the website or mobile app. 

Refund and Cancellation Policy

Before considering a refund, our first line of action is to see if we can rectify the problem you are having. A refund will only be issued in instances where services we have provided cannot be rectified. Once you request for a refund, we will investigate this request and notify you on the status of your refund after any such investigation.

 If your request is approved, we will initiate a refund to your credit card (or original method of payment). You will receive the credit within a 14 working days, depending on your card issuer's policies. 

Our service is fluid and dependent on your input, therefore we cannot issue a refund for customer errors, including but not limited to: Typos and misspellings, Blank pages, incorrect information. We strongly encourage you to review your transaction details carefully before attempting to make your order.

Customers are permitted to cancel an order in the following instances:

  1. In the event that the card details provided by a customer is not recognised by our system or is unable to be processed due to but not limited to problem with card issuer or bank, problem with our server and problem with customers server.

  2. If the customer is no longer in need of the service. Any such cancellation can only be made fifteen (15) minutes after an order has been made and so long as we have not processed the order yet and/or sent a technician en-route to your location.

  3. If the technician, we have provided does not arrive 20 minutes after the arrival time or due time given to you at the time of order.

Fraudulent Transactions 
In the event of any claim that your payment card has been used without your permission or any other fraudulent use of payment cards, we will assist the bank and police authorities with any investigations including providing them with all the details used to register associated profiles, card authentication and any communications through or related to the Site. Falsely making any such fraudulent claims can result in your card being blacklisted which will affect your future card purchases. Denying a purchase that you have made is illegal and may result in legal action towards you, which can lead to prosecution, fines and impairment of your credit rating.

Intellectual Property

Subject to other terms in these Terms and Conditions, all Content included on the Website and mobile app, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Oilee LLC, our affiliates or other relevant third parties. By continuing to use the Website or mobile app, you acknowledge that such material is protected by applicable laws of the state of California, USA and International Intellectual Property and other laws. You may not reproduce, copy, distribute, store or in any other fashion re-use material from the Website unless otherwise indicated on the Website or unless given express written permission to do so by Oilee LLC.

This Website may contain links to other sites.  Unless expressly stated, these sites are not under the control of Oilee LLC or that of our affiliates.  We assume no responsibility for the content of such websites and disclaim liability for any and all forms of loss or damage arising out of the use of them.  The inclusion of a link to another site on this Website does not imply any endorsement of the sites themselves or of those in control of them.

Use of the website

When using the website or mobile App and our service, you shall act in accordance with the following rules:

  1. You must not use obscene or vulgar language;

  2. You must not submit Content that is unlawful or otherwise objectionable. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;

  3. You must not submit Content that is intended to promote or incite violence;

  4. It is advised that submissions are made using the English language as we may be unable to respond to enquiries submitted in any other languages;

  5. The means by which you identify yourself must not violate these Terms and Conditions or any applicable laws;

  6. You must be polite to our staff and technicians, you shall not use any swear word or make any racist, sexist, threating words towards our staff and/or technicians provided to you.

Please be advised that the technician we provide reserves the right to terminate the order and leave the location of the breakdown if the technician experiences inappropriate, threatening, hostile or offensive behaviour from you or in the event that the technician feels unsafe.

Accounts

In order to procure Services on this Website you are required to create an Account which will contain certain personal details and Payment Information which may vary based upon your use of the Website as we may not require payment information until you wish to make a purchase.  By continuing to use this Website or our mobile app you represent and warrant that:

  1. all information you submit is accurate and truthful;

  2. you have permission to submit Payment Information where permission may be required; and

  3. you will keep this information accurate and up to date.

It is recommended that you do not share your Account details, particularly your username and password.  We accept no liability for any losses or damages incurred as a result of your Account details being shared by you.  If you use a shared computer, it is recommended that you do not save your Account details in your internet browser. If you have reason to believe that your Account details have been obtained by another without consent, you should contact Oilee LLC immediately to suspend your Account and cancel any unauthorized orders or payments that may be pending.  Please be aware that orders or payments can only be cancelled up until provision of Services has commenced.  In the event that an unauthorized provision commences prior to your notifying us of the unauthorized nature of the order or payment, Oilee LLC accepts no liability or responsibility and you should make contact with the third-party service provider detailed in the Purchase Information.

Termination and Cancellation

We may terminate your Account If we observe you have breached any terms of this agreement. You will be notified by email and an explanation for the termination will be provided.  Notwithstanding the foregoing, we reserve the right to terminate without giving reasons. If we terminate your Account, any current or pending orders or payments on your Account will be cancelled and provision of Services will not commence.

Oilee LLC reserves the right to cancel orders or payments without stating reasons, for any reason prior to processing payment or commencing Services provision.

If you are purchasing as a consumer and not as a business, you have the right to cancel your order for the Services within a statutory 7 working days cooling-off period.  This period begins when you receive written confirmation of your order from us. If the provision of the Services commences within the cooling-off period, your right to cancel under this provision shall end.

If orders or payments are cancelled for any reason prior to commencement of Services provision you will be refunded any monies paid in relation to those purchases. If you terminate your Account any non-completed orders or payments will be cancelled, and you will be refunded any monies paid in relation to those orders.

Services, Pricing and Availability

Whilst every effort has been made to ensure that all descriptions of Services available on our site and mobile app correspond to the actual Services, we are not responsible for any variations from these descriptions.  This does not exclude our liability for mistakes due to negligence on our part and refers only to variations of the correct Services, not different Services altogether. All pricing information on the Website and mobile app is correct at the time of going online. Oilee LLC reserves the right to change prices and alter or remove any special offers from time to time and as necessary.

In the event that prices are changed during the period between an order being placed for Services and Oilee LLC processing that order and taking payment, you will be contacted prior to your order being processed with details of the new price. 

Provision of Services

Provision of Services shall commence when full payment has been received or as otherwise detailed in the Terms & Conditions pertaining directly to those Services. We shall do our best to provide the Services with reasonable skill and care.

In the event that Services are provided that are not in conformity with your order and thus incorrect, you should contact us within 7 Business days to inform us of the mistake. we will ensure that any necessary corrections to the Services provided are made within 7 Business days.

Our Responsibilities

Your safety when using our site is paramount to us. Hence, all reasonable skill and care shall be taken to ensure your safety when using our website and/or mobile app. Please kindly note that whilst the security of your personal information is important to us, remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.

We will do our best to maintain the operation of the Site and mobile app for the Service, however, we may need to temporarily suspend the Service for operational reasons (e.g. for repairs, planned auto care or upgrades). We promise to restore the Service as soon as reasonably possible after any suspension.

If we cannot do what we have promised in these Terms because of something beyond our reasonable control (including, without limitation, disputes involving our employees), we will not be liable for this.

Disclaimers

We do not make any warranty or representation that the Website will meet your requirements, that it will be fit for a particular purpose, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. We make no guarantee of any specific results from the use of our Service or Services.

Whilst we do our best to ensure that the Website and mobile app is secure and free of errors, viruses and other malware, all Users are advised to take responsibility for their own security, that of their personal details and their computers.

Third-party websites with links from the Site have not been verified or reviewed by Oilee LLC and use and access of such third-party websites is made at your own risk.

Modification of Service and these Terms and Conditions

Oilee LLC reserves the right to change the Website and mobile app, its Content or these Terms and Conditions at any time. You will be bound by any changes to the Terms and Conditions from the first time you use the Website and mobile app following the changes.  If we are required by law to make any changes to Terms and Conditions, these changes will apply automatically to any orders currently pending in addition to any orders placed by you in the future.

Limitation of Liability

To the maximum extent permitted by law, Oilee LLC accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Website or mobile app or any information contained therein. Users should be aware that they use the Website or mobile app and its Content at their own risk. We accept no liability for any disruption or non-availability of the Website or mobile app resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

If we fail to comply with these terms and/or any of our services as promised to you, we are responsible for any reasonable loss or damage you suffer that is a foreseeable result of us breaking this agreement or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.

For New tires with 10 days warranty, warranty does not cover intentional damage and burnouts. There is a limited amount of request per month, per year available to clients. Finally, chip repairs are not guaranteed to resolve any issues raised during consultation nor do we guarantee that any problem raised would disappear. Charging of EV’s varies depending on vehicle and size.

Unless it is caused by us and is reasonably foreseeable, we will generally not be liable for:

  • any incorrect or inaccurate information on the Site or mobile app and all interruptions to or delays in updating the Service;

  • the infringement by any person of any Intellectual Property Rights of any third party caused by their use of the Site or mobile app;

  • any amount or kind of loss or damage due to viruses or other malicious software that may infect a user's computer equipment, software, data or other property caused by persons accessing, using or downloading the Site or mobile app, or from transmissions via emails or attachments received from Oilee LLC or its licensees.

Nothing in these Terms and Conditions excludes or restricts our liability for death or personal injury resulting from any negligence or fraud on our part. Nonetheless, you shall indemnify and hold Oilee LLC harmless from any loss, liability, costs and expenses, including attorney’s fees, arising out of any claim of injury or damage from the services; caused by your negligence or misconduct or breach of the terms set out on our site and/or mobile app.

No Waiver

Any default, delay or omission of any of the provisions of this Agreement by either Party will not be construed as a waiver of any subsequent breach of the same or other provisions. We are entitled to still pursue any omitted or failed payment by you at any time.

Severability

In the event that any of the provisions of this Agreement are held to be invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable parts severed from the remainder of this Agreement.

Resolving Disputes

Any dispute arising from this Agreement shall be resolved through mediation. If the dispute cannot be resolved through mediation, then the dispute will be resolved through binding arbitration conducted by a qualified arbitrator from American Arbitration Association (AAA) agreed upon by the parties.  

Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

Third Party Rights

Nothing in these Terms and Conditions shall confer any rights upon any third party.  The agreement created by these Terms and Conditions is between you and Oilee LLC.

Law and Jurisdiction

These Terms and Conditions and the relationship between you and Oilee LLC shall be governed by and construed in accordance with the Law in the state of California, USA and you agree to submit to the exclusive jurisdiction of the Courts of California, USA.

Claims 

In the event that you have any claim or action against a technician we have provided or a member of our staff, you agree to pursue such claim or action independently of and without any demands to us, and you release us from all claims, liability and damages, arising from or in any way connected to the claim or action.

If a claim or action is brought against us from your activities or use of the Site or mobile app or the Service, including any breach by you of these Terms or any charges or complaints made by other parties against you, you agree to pay, hold harmless and defend us in the claim or action. You also agree to take all reasonable steps required in the defense of any claim and allow us to assume the exclusive defense and control of the matter at our discretion.

Entire Agreement

These Terms, the Privacy Policy, refund policy and any other agreement contained on the Site and mobile app or agreed by the parties constitute the entire agreement between you and Oilee LLC. 

Information about our use of Cookies

We use cookies on our website to provide you with a better user experience. We do this by placing a small text file on your device / computer hard drive to track how you use the website and mobile app, to record or log whether you have seen particular messages that we display, to keep you logged into the website where applicable, to display relevant adverts or content, referred you to a third party website.
